Terms of Service
These terms govern your use of Hque (the Service), operated by Wain Digital Pty Ltd (we, us). By creating an account you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.
1. Your account
You must give accurate registration details and keep them current. You are responsible for activity under your account, for keeping credentials secure, and for the people you invite — including staff who sign in to the staff app with a PIN. Tell us promptly at info@hque.ai if you believe an account has been compromised.
2. Trial, subscription and billing
New accounts start on a 14-day free trial with no payment details required. After the trial you may subscribe to a paid plan; the fees, billing period and currency are those shown to you at the time of purchase. Payments are handled by our payment provider, and your card details are held by them, not by us.
You can cancel at any time. Cancellation stops future renewals and takes effect at the end of the period you have already paid for. Except where the law requires otherwise, fees already paid are not refundable.
3. Acceptable use
You agree not to:
- use the Service unlawfully, or to store unlawful content;
- upload material you do not have the right to upload;
- attempt to gain unauthorised access to the Service, other customers' data, or the underlying infrastructure;
- interfere with, overload or disrupt the Service;
- attempt to alter, forge or circumvent records in the audit trail, or misrepresent who carried out work.
4. Your data
Your procedures, records, attestations, uploaded files and staff details remain yours. You grant us the licence needed to host, process, transmit and back up that material for the purpose of providing the Service to you. We do not sell your data. Personal information is handled as set out in our Privacy Policy.
You are responsible for having a lawful basis to record information about your staff and for telling them how their information will be used.
5. The audit trail
The Service records completed procedure steps and attestations into a tamper-evident, hash-chained ledger. This is deliberate and you should understand what it means:
- entries are designed so that they cannot be silently altered or removed after the fact — including by us;
- corrections are made by adding a new record, not by rewriting an old one;
- a record therefore preserves what was originally entered, including mistakes.
Tamper-evidence means changes to a sealed record are detectable. It is not a warranty that any particular record is accurate — accuracy depends on what your people entered at the time.
6. Availability and support
We take reasonable steps to keep the Service available and secure, but we do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw features, and will give reasonable notice of material changes that adversely affect you. Planned maintenance may cause temporary unavailability.
7. Suspension and termination
You may close your account at any time. We may suspend or terminate access if you materially breach these terms, if your payment fails and stays unresolved, or if we are required to by law. Before closing your account, export any records you need to keep. After termination we may delete your data in accordance with our Privacy Policy and our retention obligations.
8. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability can be limited, it is limited, at our option, to resupplying the Service or paying the cost of having it resupplied.
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, or loss arising from your reliance on records you or your people created. Our total liability in any 12-month period will not exceed the fees you paid us in that period.
The Service helps you record and evidence work. It does not provide legal, safety, medical or compliance advice, and using it does not by itself make you compliant with any law, standard or industry obligation.
9. Changes to these terms
We may update these terms. Each version carries a version number and date. If a change materially affects your rights we will give reasonable notice before it takes effect. Continuing to use the Service after that means you accept the updated terms.
10. Governing law
These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of that jurisdiction.
